AUGUST 12, 2024
The regular meeting of the Funkstown Mayor and Council was held on Monday, August 12, 2024, at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.
In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Terry Feiser, Gary Middlekauff, John Phillips, III, Rich Gaver, and Barry Warrenfeltz.
Also in attendance were Connor Shank, Matt James, Marie Royce, C. Gregory Fogle, Sam Sarvey, Angel Stewart, and Brenda Haynes, Town Manager.
This meeting of the Mayor and Council, in compliance with the Maryland Open Meetings Law and the Emergency Ordinance of the Town regarding Open Meeting Compliance, will be audio streamed via the Town’s Facebook page. In person attendance is now permitted at the meetings.

Minutes
Motion was made by Councilman Rich Gaver, seconded by Councilman Gary Middlekauff to approve the minutes. Unanimously approved.
Misc
Councilman Rich Gaver stated that the barn was vandalized. The three boys were caught on camera and their parents were notified through the Washington County Sheriff’s Department. Each parent will split the cost totaling $350.00.
Councilman Barry Warrenfeltz stated that the Do Not Enter sign on the corner of Cemetery Street and Westside Avenue needs to be replaced.
Mr. Connor Shank stated that the plans for the Funkstown Food Truck Festival are complete. The event is scheduled for Saturday, September 7th from 5 to 9 p.m. There will be food trucks, ax throwing, moon bounce inflatables, car show, band called “The Few”, 9-hole portable golf, and fireworks at dusk.
The Halloween Parade will be held on Thursday, October 24th, and trick or treat will be Friday, October 25th from 6 to 8 p.m.

The regular meeting of the Funkstown Mayor and Council was held on Monday, July 8, 2024, at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

Re-enactment – July 20-21, 2024
Councilman John Phillips, III stated that the Town is receiving a lot of registrations. There will be a fashion and tea party, and so far, there are fifty to sixty registered. The fire police will be given a $300 donation. The fire company will serve food at pavilion three. Assistant Mayor Sharon Chirgott, and Councilman Terry Feiser will help with registration on Friday.
Award of Contract Approval – Guyer Brothers, Inc. – Sanitary Sewer Collection System Rehabilitation (I&I Project)
The project was put out to bid twice, and the only company that bid on the project each time was Guyer Brothers, Inc. Motion was made by Councilman John Phillips, III, seconded by Assistant Mayor Sharon Chirgott to accept Guyer Brothers, inc. Bid for the I&I Project in the amount of $327,560.00. Unanimously approved.
Misc
Councilman Rich Gaver stated that he donated rose bushes to put around the digital sign on Frederick Road. The Town is currently waiting on Potomac Edison to make the connection.
Councilman Rich Gaver stated that the Boy Scouts handed out the re-enactment flyers. An additional five flyers will be needed next year for the Boy Scouts to hand out due to the new development.

The regular meeting of the Funkstown Mayor and Council was held on Monday, June 18, 2024 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

Public Hearing
The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a proposed water rate increase and adoption of the General Fund and Enterprise Fund Budgets.
The public hearing is scheduled pursuant to the provisions of the Annotated Code of Maryland and the Charter of the Town of Funkstown, to consider whether or not to revise the water rates, and adoption of the budgets.
There were no public comments at the hearing.
Motion was made by Councilman Barry Warrenfeltz, seconded by Assistant Mayor Sharon Chirgott to close the public hearing. Unanimously approved.
Water Rates
The City of Hagerstown will be increasing the water rates to the Town by fourteen (14) percent each year for the next three years. This will become effective starting July 1, 2024.
Motion was made by Councilman Terry Feiser, seconded by Councilman Barry Warrenfeltz to increase the in town rates 14% and the out of town rates 15%. Unanimously approved.
Budget
Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Barry Warrenfeltz to adopt the General Fund and the Enterprise Fund Budgets for Fiscal Year July 1, 2024 to June 30, 2025, and the Budget Ordinance. Unanimously approved.

Curb Cut – 14 West Cemetery Street
Mr. and Mrs. Hady own and reside at 14 West Cemetery Street. They would like to request a curb cut to install a 20’ x 36’ concrete driveway on the eastern side of their property. The project will replace a cracked and deteriorated section of a sidewalk.
Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Barry Warrenfeltz to allow a curb cut to install a driveway at 14 West Cemetery Street. Unanimously approved.
Charlie Evans
Mr. Charlie Evans lives at 18 East Maple Street. He addressed the Mayor and Council concerning ordinances for overgrown weeds and junk on properties, especially old vehicles and outbuildings, tents, etc. He submitted an email for the Town’s file. Mr. Evans referenced the property owned by Donald Kline at 15 East Baltimore Street. The front of his property has a privacy fence so the overgrown weeds and junk to the rear of his property cannot be seen. However, the residents on East Maple Street can see it, and for the property owners that take pride in neatly trimmed yards, is a disgrace to the community. He provided pictures for reference. Mr. Jeb Eckstine lives at 13 East Baltimore Street. He submitted an email and pictures complaining of the property located at 15 East Baltimore Street. Mr. Eckstine’s email stated that this issue has been going on for many years, and the neighbors are tired of seeing it. The Mayor and Council directed Councilman Terry Feiser to write Mr. Kline a letter regarding violation of the Weed Ordinance. A Junk Ordinance will be discussed with the Town Attorney to adopt that has enforcement.

Funkstown Fire Company Email – Re-enactment
The Funkstown Fire Company Committee sent an email to the Mayor and Council indicating they have decided to participate in the event. Their hours of operation will be Saturday 11 am until 7 pm and Sunday 7 am until 10:30 am. They have consolidated the serving hours on Saturday slightly based on the 2023 sales volume.
Hazard Mitigation Plan
Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to adopt the Washington County Hazard Mitigation Plan. Unanimously approved.

Troy Cavell – J&J Trash Service
Mr. Troy Cavell owns J&J Trash Service. Collectors Trash Service sold the contract to J&J Trash Service on December 1, 2023. Mr. Cavell stated that J&J Trash Service is a family-owned business, operating since 1997. They serve Carroll, Frederick, and Washington counties. They have 50 trucks, and 100 employees. Mr. Cavell is proposing no change in the upcoming fiscal year contract but would like to change the service day for waste collection and yard waste collection to be picked up on Wednesday. Yard waste and waste collection would still need to be separated, but separate trucks would come through town. This would eliminate delays in service due to holidays, with the exception when a holiday would fall on a Wednesday, then it would be picked up the next day.
Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to accept J&J Trash Service for next fiscal year with no price change, and to change pickup day from Tuesday and Thursday to Wednesday pickup for both. Unanimously approved.
Funkstown Fire Company Letter
Mr. Robert Rodgers, Committee Chairman, with the Funkstown Volunteer Fire Company (FVFC) sent a letter to the Mayor and Council stating that they will not be participating in the 2024 Re-enactment event unless assurances can be made geared toward improving the event. The FVFC committee is not making a profit due to the low attendance. A lengthy discussion was held on what can be done to help increase attendance. Councilman John Phillips, III presented a quote from High Expectation Enterprises for Bounce Houses, Slides, an Obstacle Course, and Mini Putt-Putt for $1,495. This would provide entertainment for the children.

Motion was made by Councilman Rich Gaver, seconded by Councilman Gary Middlekauff to accept the bid for High Expectations Enterprises for $1,495 for the Re-enactment event in July. Unanimously approved, with the exception that Councilman John Philipps, III abstained from voting.
Pump Station Update
Mr. Jeff Haynes with Haynes Controls provided a detailed packet showing the upgrade of the control panel at Pump Station 3 (Edgewood Drive) with before and after pictures.
Councilman Rich Gaver stated that he went to the pump station to look at the work that was done, and he has been doing electrical work for over 27 years, and that was the best work he has seen. One item that was not approved to be done is a surge protection device (TVVS). This device is a phase loss surge protector for power loss.
Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to approve a TVVS device for Pump Station 3. Unanimously approved.
Councilman Rich Gaver stated that Pump Station 4 (Funkstown Park) control panel upgrade has been started. This pump station’s float controls, and transducer cannot be reused due to age and deterioration. This expense would be an additional $10,000.
Motion was made by Councilman Barry Warrenfeltz, seconded by Councilman Barry Warrenfeltz to approve the additional expense of $10,000 for Pump Station 4. Unanimously approved.
A discussion was held regarding monitoring of the pump stations. Councilman Rich Gaver stated that should be phased in. Antietam Cable already has service at the park, so the price for monitoring services will be investigated for this station first.

Misc
Councilman Barry Warrenfeltz stated that the shed on Chestnut Street beside the church parking lot is owned by the church and was put there as a school bus stop shelter. The shed has the legal address of 18 East Chestnut Street. He has received complaints regarding drug activity in the shed. He is going to send a letter to the school board to advise them of the shelter building, and if they choose not to move the bus stop then the building will probably be taken down.
Councilman Rich Gaver stated that he and Councilman Terry Feiser did drenching at the park and Jeff Haynes provided and installed the fiber as a gift to the Town. Councilman Rich Gaver asked Jeff Haynes to get a price on the network connection components needed to use the fiber for better internet service at the park.
Councilman Rich Gaver had a lengthy discussion regarding the Funkstown web page. The web page was pulled up on a large TV for the council to view. In put was provided and Councilman Rich Gaver will make some changes to the main page to see if the Mayor and Council approve.

Glenn Fuscsick – Funkstown Fire Company
Mr. Glenn Fuscsick is President of the Funkstown Fire Company. Mr. Fuscsick and several fire company members attended the meeting regarding this year’s Re-enactment. The fire company serves food on Saturday and Sunday. Last year they put in 120 man hours and the sales were very low. Their net profit for the event was $400.00. A lengthy discussion was held regarding the attendance and how to better promote the event, and also changing the web page to do a complete overhaul to make it more user friendly. They are only willing to serve breakfast on Sunday.
Chad Walker – Wagon Train
Mr. Chad Walker was not in attendance, but the Mayor and Council approved the Wagon Train to spend the night at the Funkstown Park on Saturday, May 18, 2024. Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to approve a $500.00 donation from the Hotel/Motel funding for the annual Wagon Train event. Unanimously approved.
Constant Yield Tax Rate
The Constant Yield Tax Rate is calculated by the MD Department of Assessments and Taxation for each taxing authority in Maryland. It represents the Real Property Tax Rate for the coming tax year that will generate the same amount of revenue that was generated during the current tax year. The potential revenue for Fiscal Year 2024-2025 is $314,572. Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips, III to keep the tax rate at .37 (per $100) for Fiscal Year 2024-2025. Unanimously approved.
Proposed Annexation – 2 Lots on Emmert Road adjoining Gaver Meadows
There are two lots on Emmert Road that adjoin Gaver Meadows. Mr. Lyles would like to annex those lots into the town. Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to approve sending the paperwork to the town attorney to start the annexation process. Unanimously approved.
Washington County Hazard Mitigation Plan (2023 Update) – Review
The Washington County Hazard Mitigation Plan was presented to the Mayor and Council for review. This plan is updated every five years. A Resolution will be at next month’s meeting for final adoption.
MML Dinner
A count was taken for the next MML Dinner to be hosted by the City of Hagerstown on Monday, March 25, 2024. The dinner will be held at Western Enterprise Fire Company located at 526 Washington Avenue. The social hour will begin at 6:00 p.m. followed by the evening meal at 6:30 p.m. The menu for the evening will consist of vegetable and cheese trays, tossed salad, shaved roast beef, salmon croquettes, mashed potatoes and gravy, green beans, cherry pie or carrot cake. The cost for this meal will be $20.00.
Misc
Washington County Commissioner Jeff Cline attends the re-enactment every year and enjoys it.
Deputy Dakota Watson gave the Mayor and Council a report for the month of February.

MML Dinner
The Town of Funkstown will be hosting the MML dinner on Monday, January 22, 2024. The dinner will be held at the Elks Lodge located at 11063 Robinwood Drive, Hagerstown. The menu for the evening will consist of broasted chicken, broiled salmon filet, baked sugar cured ham, scalloped potatoes, green beans, tossed salad, cherry pie, coffee, hot and iced tea. A cash bar will be available.
Misc
Mason Churchey is with Scout Troop 23, and for his Eagle Project he constructed an 8×8 pavilion with a bench at the Funkstown Community Park. The location overlooks both baseball fields. He was very grateful to give back to the community. The Mayor and Council thanked him for doing his project at the Funkstown Park, and he did an outstanding job.
Ms. Marie Royce thanked the Mayor and Council for having the curbs cleaned up on Baltimore Street.
Councilman John Phillips, III stated that he is working on the Re-enactment details for this year. The dates are July 19-21, 2024. He will be contacting the fire company to help with the food again, and the website needs to be updated.
