MINUTES

DECEMBER 14, 2021

The regular meeting of the Funkstown Mayor and Council was held on Tuesday, December 14, 2021 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Terry Feiser, Barry Warrenfeltz, and Rich Gaver.

In attendance by telephone conference was Gary Middlekauff.  Also in attendance were Kevin Spielman, Jeanie Doney, and Brenda Haynes, Town Manager.

This meeting of the Mayor and Council, in compliance with the Maryland Open Meetings Law and the Emergency Ordinance of the Town regarding Open Meeting Compliance, will be audio streamed via the Town’s Facebook page.  In person attendance is now permitted at the meetings with social distancing and masks required.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Motion was made by Councilman Terry Feiser, seconded by Councilman Rich Gaver to approve the minutes. Unanimously approved.

Bud Gudmundson – Revised Memorandum of Understanding – MOU

A lengthy discussion was held with Mr. Gudmundson regarding the Mayor and Council signing the MOU with Washington County.

Motion was made by Councilman Barry Warrenfeltz, seconded by Councilman Terry Feiser to approve the Washington County MOU.  Unanimously approved.

Motion was made by Councilman Barry Warrenfeltz, seconded by Councilman Terry Feiser to adopt an Ordinance to Approve Memorandum of Understanding Between the Town of Funkstown and the Board of County Commissioners of Washington County regarding Addressing and Road Naming.  Unanimously approved.

Jordan Whittington – Monarch Alliance Grant Proposal

Ms. Jordan Whittington is working with the HCC Environmental Club to research plants and benefits to pollinators and native species in the 2.34 acre lot in Funkstown and along the Antietam Creek.  The Antietam-Conococheague Watershed Alliance is now interested in participating in the project to plant native trees.  Ms. Whittington would like to apply for a $1,000 grant to plant 322 plants at the new Funkstown Park on Poplar Street.

A discussion was held on what type of plants would be planted at the park.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to approve Ms. Whittington to apply for a grant and to plant 322 plants at the new Funkstown Park with a contingency that the project falls into the realm of the proposed plan for the park.  Unanimously approved.

Misc

Mr. Kevin Spielman stated that the new park on Poplar Street looks very nice with the trailers removed.

Councilman Rich Gaver stated that the Olde Tyme Christmas event was very successful.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to pay the bills.  Unanimously approved.

The regular meeting of the Funkstown Mayor and Council was held on Monday, November 8, 2021 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Assistant Mayor Sharon Chirgott, Terry Feiser, Barry Warrenfeltz, Gary Middlekauff, Rich Gaver, and John Phillips, III.

In attendance by telephone conference was Ed Kuczynski, Town Attorney.  Also in attendance were Zachary Kieffer, and Brenda Haynes, Town Manager.

Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to approve the minutes.  Unanimoulsy approved.

Acceptance of Petition for Annexation and Introduction of Annexation Resolution – Paul Crampton Contractors, Inc.

A Petition for Annexation of +/4.79 acres, South Edgewood Drive, Hagerstown, MD 21740 into the Town of Funkstown to enlarge the corporate boundaries of the Town of Funkstown by annexing and including therein +/-4.79 acres of real property locate on S. Edgewood Drive and shown as Parcel: 0044 on Tax Map: 0049, together with all of the improvements, rights ways, privileges and appurtenances thereunto belonging.  The Property is shown and described as the “Parcel 3 Liber 6303, Folio 168 to be Annexed to the Town of Funkstown on the “Annexation Plat Lands of Paul Crampton Contractors, Inc. prepared by Fox & Associates, Inc. dated August 2020 which is attached hereto and incorporated herein as Exhibit #1, and more particularly described by the metes and bounds legal description attached hereto and incorporated herein as Exhibit #2, which shall be appended to the current legal description of the Town of Funkstown.  The Property is contiguous and adjoining to the existing corporate limits of the Town of Funkstown and this annexation will not create any unincorporated limits of the Town, real property proposed to be within the corporate limits of the city as a result of the proposed annexation, or any combination of such properties.  The property would be zoned (SR) Suburban Residental.

Motion was made by Councilman Rich Gaver, seconded by Councilman Terry Feiser to accept the Petition for Annexation and approve the Resolution of the Mayor and Council of the Town of Funkstown, Maryland to enlarge the corporate boundaries and thereby amend the corporate boundaries as contained in the appendix of the Charter of the Town of Funkstown and to establish the zoning classification of the area to be annexed.  Unanimously approved.

Revised Memorandum of Understanding – MOU

A lengthy discussion was held again this month regarding the MOU and the Addressing Ordinance for Washington County, Maryland.  Councilman Rich Gaver does not like the verbiage of Article 3.3 of the Ordinance.  Councilman Terry Feiser stated that the Copper Kettle Trailer Park is currently having issues with the utility companies because the County changed the addresses of the trailer park.  The Mayor and Council directed the town manager to ask a county representative to attend next month’s meeting to answer questions so this issue can be resolved.

MML Dinner

A count was taken for the next MML dinner will be held on Monday, November 22, 2021 and will be hosted by the Town of Clear Spring.  The meeting will be held at the Clear Spring American Legion located at 12335 Big Spring Road.  The social hour will begin at 6:00 p.m., followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of baked haddock, roast beef and gravy, baked potato, corn, tossed salad, roll and butter, and dessert.  The cost for this meal will be $25.00.

Misc

Councilman Rich Gaver stated that the plans for the Olde Tyme Christmas event are coming along.  The wagon rides will be set up in front of the church, refreshments and a few raffles will be located under the tent in front of Town Hall.  There will be pony rides at the park, and the Boy Scouts will be serving hot dogs and popcorn at the park.  The ornament this year will be the Jacob Hebb Funeral Parlor dated 1912.

Councilman John Phillips, III stated that the paving on Green Street is complete.

Councilman John Phillips, III stated that he would like to see that the Funkstown Fire Company gets $25,000 of the stimulus money that the Town has been provided with for infrastructure projects.  This will be discussed further when the Mayor and Council holds their workshop meeting.

Councilman Gary Middlekauff stated that Poplar Street has less traffic since the Antietam Village Trailer Park is gone.

The employee Christmas luncheon will be skipped this year.

OCTOBER 25, 2021

The regular meeting of the Funkstown Mayor and Council was held on Monday, October 25, 2021 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

Mr. Kery Swope, Manager with Albright Crumbacker and Moul & Itell, LLC, presented the annual audit report.  The Town has a “clean, unqualified opinion.”

Lion Martin Bonura – Funkstown Lions Club

Mr. Bonura addressed the Mayor and Council regarding the Funkstown Lions Club.  Until June 2021, the club met on the second and fourth Wednesdays at St. Paul’s Lutheran Church.  The Funkstown Lions Club returned their charter to District 22-W in June 2021.  The community of Funkstown is without this local service organization.  Lions Clubs are local and provide service to their local community and to the world with their mission “to empower Lions clubs.  Mr. Bonura is seeking help to revitalize the club to serve the citizens of Funkstown.

Email from Aladdin Awards

Mr. Neff submitted an email regarding parking issues due to events being held at Blue Mountain Wine Crafters.  Mr. Neff stated that “One place is still allowed to use a gravel lane and grass for parking.  These have now become regular business occurrences not “special” events.  Other businesses were required to have paved parking.”

The Mayor and Council would like the Town Attorney to review the file of Blue Mountain Wine Crafters and send a letter regarding outdoor activity.

Halloween Parade Update

The Funkstown Halloween Parade will be held on Thursday, October 28th at 6:00 p.m.  The only band this year will be South Hagerstown High School Band due to COVID restrictions that the School Board has put in place.  The Funkstown Legion will pass out hot dogs and a drink at the outside pavilion, and the Ladies Auxiliary will hand out candy bags outside.

Olde Tyme Christmas

The Funkstown Olde Tyme Christmas event will be held on December 10th at 6:00 p.m.  Councilman Rich Gaver stated that all activities will be held outside this year.  A 10×20 tent will be set up outside in front of Town Hall for refreshments.  The Antique Tractor Club will provide Wagon Rides that will be set up in front of the church.  Pony rides will be at the Funkstown Community Park, and the Boy Scouts will have a bon fire and smores at the park.  The Christmas Ornament this year will be the old funeral home that was on Baltimore Street.

Misc

Ms. Ginny Atkinson addressed the Mayor and Council regarding the proposed warehouse development on Howell Road/Harrison Tract. 

Mr. Jerry Keplinger is the Fire Chief at the Funkstown Fire Company.  With the help of Washington County, the fire station is now staffed 24 hours a day.  Mr. Keplinger requested to the Mayor and Council that the fire company would like to install a dry hydrant at the Antietam Village Trailer Park to obtain water from the Antietam Creek as necessary. The fire company will also check with MDE and DNR for additional approval.                                                                                                                                      Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to allow the Funkstown Fire Company to install a dry hydrant at the Antietam Village Trailer Park to obtain water from the Antietam Creek as necessary.  Unanimously approved.

Councilman Rich Gaver would like a copy of the Washington County Ordinance 2012-38 that is referenced to in the MOU paperwork.  The Town Manager will email the Mayor and Council a copy prior to the next meeting.

Revised Memorandum of Understanding (MOU)

The Mayor and Council reviewed the email from Mr. Bud Gudmundson, GIS Manager with Washington County, regarding changes that the County Commissioners made removing the section regarding address and road name changes.

Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to table a discussion until next month to get further clarification on the changes.  Unanimously approved.

MML Dinner

The next scheduled meeting of the Maryland Municipal League will be held on Monday, September 27, 2021 and will be hosted by the Town of Keedysville.  The meeting will be held at the McClellan Gun Club located at 5241 Red Hill Road in Keedysville.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of grilled steak, baked potato, green beans, and dessert.  The cost for this meal will be $25.00.

Misc

Councilman Barry Warrenfeltz stated that the Labor Day celebration was a huge success, and thanked everyone who helped with the event.

Councilman John Phillips, III stated that the Labor Day weekend celebration had an excellent turnout. 

Councilman Gary Middlekauff stated that the trash company is doing a good job.

Councilman Gary Middlekauff stated that four wheelers and dirt bikes are riding through the town driving the wrong way on the streets.

Councilman Terry Feiser suggested offering the employees a check in the amount to be determined from the Stimulus Money that the Town will be receiving.  The County is giving money to their employees, and Councilman Terry Feiser stated that the three employees have worked through the COVID pandemic.  The Mayor and Council would like to wait until the Town receives the funding to make a final decision.

The Mayor and Council offered their thoughts and prayers for Commissioner Terry Baker who is in the hospital battling COVID.

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips, III to close the meeting and go into closed session.  Unanimously approved.

Sharon Chirgott – Charging Station

The Charging Station is tabled, and will be discussed next month.

Karen Hoagland – Discussion of proposed development (Harrison Tract – 1527 Howell Road)

Ms. Karen Hoagland has lived on Beaver Creek Road in Funkstown for many years.  She has presented to the Mayor and Council a petition that she has started to stop the Edgewood Drive Warehouse Project.  The proposed development is known as the Harrison Tract 1527 on Howell Road.  The current development plan is for a Class A Industrial Warehouse Complex containing two buildings totaling 1.9 million square feet of space, with an expected tractor trailer traffic of over 2,000 trucks per day.              A summary of the project will be that the parcel is under contract by development partners Harris Lopato, Curated Development Group and David Strouse, Birchwood Capital Partnership.  The project is a proposed 1.91 mil square foot warehouse/distribution center, and the development is to built on speculation, and possible built-to-suit.  The estimated investment will be $140 mil and an estimated 2,200 jobs.  A lengthy discussion was held regarding the proposed development, and the possible elimination of a portion of the Southern Blvd.

Funkstown Fire Company

Mr. Gary Farrell is the President at the Funkstown Fire Company.  Since June 2021, the fire company is staffed 24/7 through Washington County.  They are still looking for volunteers.  The staff at the fire company is looking to add an addition to the fire station.  They are looking to add two bays, and height is important.  The Floodplain changes could cause an issue with the proposed addition.

The annual duck race will be held on August 28th.  The ducks are $5.00 each or seven for $25.00.  There will also be a barbecue.

Funkstown Park (Artz Farm) Request

A request was made to the Mayor and Council to use the Artz Farm on September 12th for an annual cycling event.  The event is insured and sanctioned by USA Cycling, and the organization would be responsible for all setup and breakdown as well as any course restoration if needed.

The Mayor and Council do not oppose the event at the park, but since the request is short notice, and no representation was present for questions, the request was denied this year.

Misc

Ms. Ginny Atkinson lives at 308 Hebb Road.  She is attendance with Ms. Hoagland to support the petition against the proposed development on the Harrison Tract located on Howell Road.

Councilman John Phillips, III stated that the re-enactment was a huge success this year.  There were a lot of new re-enactors this year.  Connor Shank did an excellent job with the 1st Annual 5K Run.   The re-enactment will be held on the third weekend in July next year. (July 15-17, 2022)

Councilman John Phillips, III stated that he is looking forward to the Labor Day event to be held on Saturday, September 4th.  The Vantastics will be the band playing this year, fireworks, and food provided the Funkstown American Legion Baseball Team, the “Skunks”.

Councilman Rich Gaver stated that everyone enjoyed themselves at the re-enactment this year.  There was an excellent turnout for the car show.

Councilman Rich Gaver stated that there will be a car show for the Labor Day event this year.

Assistant Mayor Sharon Chirgott stated that the Halloween Parade this year will be held on Thursday, October 28th and trick or treat will be held on Friday, October 29th.

Re-enactment

The first annual 5K Run is scheduled for Saturday, July 17, 2021, starting at 8:00 a.m. on the Artz Farm property (Park Addition).  The race will be held rain or shine.  A discussion was held concerning the details.

The re-enactment plans have been finalized, and Councilman Rich Gaver provided an update.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, July 26, 2021.  The dinner will be hosted by the Town of Williamsport at the Springfield Farm Barn.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu will consist of crabs, fried chicken, corn on the cob, cole slaw, potato salad, chips, cheese tray, cookies, beverages, and adult beverages.  A special treat will be available this year – a rib-eye steak can be added for an additional $10.  The cost for this meal will be $35.00.

Trailer Park (20 West Poplar Street) Demolition Bids

The only bid submitted was Allegany Wrecking & Salvage in Hagerstown, MD.  The bid submitted was for $130,000.

JUNE 28, 2021

A special meeting of the Funkstown Mayor and Council was held on Monday, June 28, 2021 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Terry Feiser, Barry Warrenfeltz, Gary Middlekauff, and Rich Gaver.

Public Hearing

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a proposed water rate increase,  a garbage rate increase, and adoption of the General Fund and Enterprise Fund Budgets.

The public hearing is scheduled pursuant to the provisions of the Annotated Code of Maryland and the Charter of the Town of Funkstown, to consider whether or not to revise the water and adoption of the budgets.

There were no public comments at the hearing.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to close the public hearing.  Unanimously approved.

Constant Yield Tax Rate

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to keep the Constant Yield Tax Rate at .37 per hundred dollars.  Unanimously approved.

Waste Collection Bids

Waste Collection bids were accepted for the fiscal year July 1, 2021 to June 30, 2022.  Apple Valley Waste was the only bid in the amount of $69,793.00.  The bid is an increase of $5,566 from last year.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to accept the waste collection bid from Apple Valley Waste in the amount of $69,793.00 for fiscal year July 1, 2021 to June 30, 2022.  Unanimously approved.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to increase garbage rates from $36.00 per quarter per household to $41.00 per quarter per household.  An increase of $5.00 per quarter per household.  Unanimously approved.

Water Rate Increase

The City of Hagerstown will increase the water rates by three percent effective July 1, 2021.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to increase the in town and out of town rates by three percent.  Unanimously approved.

Budget

Motion was made by Councilman Rich Gaver, seconded by Councilman Terry Feiser to adopt the General Fund and Enterprise Fund Budgets for fiscal year July 1, 2021 to June 30, 2022, and the Budget Ordinance.  Unanimously approved.

Misc

Motion was made by Councilman Rich Gaver, seconded by Councilman Terry Feiser to give the employees the new Federal holiday, Juneteenth off as a paid holiday.  Unanimously approved.

Connor Shank – Re-enactment and 5K Run

A discussion was held concerning the plans for the re-enactment and the 5K run.  The committee will meet on Thursday, May 13th at 6:00 p.m. at pavilion 3 at the Funkstown Community Park.         Councilman John Phillips, III stated that there will be two bands on Saturday evening July 17th.  Devin Fields will play from 2:00 -4:00 p.m. for $150.00, and the Fantastics will play from 6:00-9:00 p.m. for $650.00.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, May 24, 2021 hosted by the Town of Williamsport.  The meeting will be held at the Springfield Farm barn.  Masks will be required and social distancing will be implemented.  The social hour will begin at 6:00 PM, followed by the evening meal at 6:45 PM.  The menu for the evening will consist of hamburgers, hot dogs, chips, salad, ice cream, beverages, and adult beverages.  Dress should be casual and comfortable.   The cost for this meal will be $15.00.

Councilman Rich Gaver stated that there are currently twelve boys working on their Eagle Scout projects.

Councilman John Phillips, III stated signs can be made and installed on Green Street for a deaf child in the neighborhood.

Councilman John Phillips, III stated that he looked at the road area at 302 East Maple Street that is very muddy due to approximately 300 square feet being used for additional parking.  This area is Town property.  The opinion to the Mayor and Council is if Mr. Giffin continues to use the area, then he will have to pave and maintain it.

Councilman Gary Middlekauff stated that a good Eagle Scout project would be repairing the storm drain on East Poplar Street.

Chad Walker – Wagon Train

Mr. Chad Walker stated that the National Pike Wagon Train event will be held this year on May 14-16, 2021.  They are working closely with MEMA and the Washington County Health Department to follow all COVID -19 rules and regulations.  Breakfast will be purchased from AC&T, and will be in individual containers.

Motion was made by Councilman John Phillips, III, seconded by Assistant Mayor Sharon Chirgott to allow the National Pike Wagon Train to stay overnight at the Funkstown Community Park on Saturday, May 15th, and provide breakfast on Sunday morning, May 16th following all COVID-19 guidelines for safety.  Unanimously approved.

Motion was made Councilman John Phillips, III, seconded by Councilman Barry Warrenfeltz to give the National Pike Wagon Train a $500 donation from the Hotel/Motel FY 2021 budget.  Unanimously approved.

Casey Snoke – Approval for Appointment to the Funkstown Planning Commission

One position remains on the Funkstown Planning Commission, and Mr. Casey Snoke has expressed an interest to serve on the Commission.

Motion was made by Councilman Barry Warrenfeltz, seconded by Assistant Mayor Sharon to approve Mr. Casey Snoke to attend the Mayor and Council meeting next month for official appointment to the Funkstown Planning Commission.  Unanimously approved.

Funkstown Park Entrance

A discussion was held regarding a letter that the Zoning Administrator sent to Brad Giffin at 302 East Maple Street.  Mr. Giffin parks a vehicle on approximately 300 square feet of  Town property for additional parking, and the area is very muddy.  The Town will be relocating the wooden fence at the Park entrance to the Town’s property line.  If Mr. Giffin continues to park in that area, the Town requests that he install gravel, asphalt, or concrete so that mud is not tracked onto Maple Street.  The Mayor and Council discussed authorizing a Quit Claim Deed to Mr. Giffin, or not allowing him to use the area unless he maintains it.  Councilman John Phillips, III will look at the area, and report back to the Mayor and Council at next month’s meeting.

Decision on the Funkstown Re-enactment

A discussion was held whether the Mayor and Council should move forward with the Re-enactment this year.  The positivity rate in Washington County is currently up.  Councilman John Phillips, III stated that as of now there will not be a street battle.  The Mayor and Council decided to wait until the end of April to make a final decision.

Mr. Neff – Shop Funkstown Retailers

Mr. Neff explained to the Mayor and Council that since the pandemic occurred, the businesses changed from the 1st Friday events to Shop Funkstown Retailers.  They will no longer have live music, and the events will be held on Saturday’s.  The events will be seasonal and held on holidays.  Mr. Neff stated that he has close to 8,000 viewers from advertising online.

Elliott Churchey – Eagle Scout Project

Mr. Elliott Churchey is with Boy Scout Troop 23 of Funkstown.  For his Eagle Scout project he would like to design and construct a Gaga Ball Pit at the Funkstown Park.  A Gaga Ball Pit is a fast paced sport played in an octagonal pit.  The more players the better.  It is a kinder gentler version of dodge ball.  The game is played with a soft foam ball, and is combined the skills of dodging, striking, running, and jumping, while trying to hit opponents with a ball below the knee.  A drawing was provided to the Mayor and Council with three different locations.    Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to approve the Eagle Scout Project for a Gaga Ball Pit to be located at the Funkstown Community Park with a site location to be determined.  Unanimously approved.

Abandoned Trailer – Donation to fire victim

A resident on West Poplar Street lost his mobile home to a fire in the Copper Kettle Trailer Court.  There is an abandoned mobile home in the Antietam Village Trailer Court that is in good condition.  The Mayor and Council have agreed to donate the mobile home with the condition that all expenses incurred to move the mobile home will be at the expense of the resident.   Motion was made by Councilman Rich Gaver, seconded by Councilman Barry Warrenfeltz to donate the mobile home to the resident.  Unanimously approved.

NexGen911 Proposed Address Changes

Address Changes – Opposition

  • A lengthy discussion was held between the Mayor and Council and Ms. Jennifer Kinzer regarding the proposed address changes that the County would like to make with several properties in Town for first responders to quickly find the property.

Motion was made by Councilman Barry Warrenfeltz, seconded by Councilman Terry Feiser to approve supporting the County with their proposed address changes as listed.  Unanimously approved.

Funkstown Alley Name

  • A discussion was held to name the alley in Funkstown Kershner Alley.

Motion was made by Councilman Terry Feiser, seconded by Councilman Rich Gaver to name the alley, Kershner Alley.  Unanimously approved.

Gaver Meadows Street Name Approval List

  • Ms. Jennifer Kinzer stated that the Washington County Planning & Zoning Department approved the street names submitted for Gaver Meadows.

Memorandum of Understanding (MOU)

A Memorandum of Understanding (MOU) has been submitted to the Town to be signed.  The MOU is between the Board of County of Commissioners of Washington County, Maryland and all the municipalities in Washington County.

The purpose of the MOU is to memorialize the Towns’ and County’s agreement regarding responsibility for assignment of site addresses and approval of proposed road names within the incorporated towns and unincorporated areas of Washington County, Maryland.

A lengthy discussion was held regarding Funkstown only giving permission for assignment of addresses and street name for new developments.  Section 8 of the MOU should be personalized for each individual municipality.  The Mayor and Council and the Town Attorney oppose Section 8 of the MOU, and will not sign the MOU unless an Addendum is officially signed and approved changing Section 8.  Ms. Jennifer Kinzer will let Mr. Bud Gudmondson and the County Attorney aware that Funkstown will not sign the MOU without an Addendum changing Section 8.

Annexation Petition – Paul Crampton Contractors, Inc.

Mayor Paul Crampton, Jr. has turned over the meeting to Assistant Mayor Sharon Chirgott, and did not participate in any discussion or voting to prevent any conflict of interest.

Paul Crampton Contractors, Inc. a Maryland Corporation has petitioned to the Town to enlarge the corporate boundaries of the Town by annexing and including therein +/- 4.79 acres of real property located on S. Edgewood Drive and shown as Parcel: 0044 on Tax Map: 0049 (the “Property”0, together with all of the improvements, rights ways, privileges and appurtenances thereunto belonging.  The property is contiguous and adjoining to the existing corporate limits of the Town, and this annexation will not create any unincorporated area which is bounded on all sides.  There are no residents living in the area to be annexed; and the Petitioner is the owner of at least twenty-five percent (25%) of the assessed valuation of the real property located in the area to be annexed.

Motion was made by Councilman John Phillips, III, seconded by Councilman Barry Warrenfeltz to approve the Annexation Petition to move forward.  Unanimously approved.

Assistant Mayor Sharon Chirgott turned the meeting back over to Mayor Paul Crampton, Jr. to continue with the Agenda items.

Hotel/Motel Request – Funkstown Small Retail Business Community

A letter has been submitted to the Mayor and Council from the Funkstown Small Retail Business Community requesting $1,000 again this year from Hotel/Motel to assist with advertising for the businesses.  All businesses will be included in the advertisements.

Motion was made by Councilman Terry Feiser, seconded by Councilman Rich Gaver to fund $1,000 from Hotel/Motel to assist with advertising for the Funkstown Small Retail Business Community.  Unanimously approved.

Funkstown Day in the Park/Re-enactment Committee Paperwork

Councilman John Phillips, III stated that he would like to move forward with making plans for the Re-enactment this year, and a final decision will be made in April due to COVID restrictions, which would still allow time for registrations to be accepted on time.

The Mayor and Council support to make a final decision at the April Mayor and Council meeting.

Fireworks – Date to be Determined

If the Re-enactment is held this year, the fireworks will be held on Saturday evening of the event.  If the re-enactment is cancelled due to COVID restrictions, the fireworks will be held on Saturday evening of Labor Day weekend.

Misc

Councilman Barry Warrenfeltz would like the contracting company that is doing the blasting to notify the affected residents in the area with a contact name and number due to complaints and concerns.

Councilman Rich Gaver stated that there is a vehicle parking in front of the house beside the post office, and is blocking the view of vehicles exiting the post office.  The town manager was directed to have town maintenance staff contact the State Highway regarding this issue.

Councilman Gary Middlekauff stated that town maintenance staff, Jeff did a good job plowing the snow during the last two storms.
