MINUTES

DECEMBER 8, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, December 8, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Rich Gaver, John Phillips, III, and Richard Nigh.

Also in attendance were Barry Warrenfeltz, Helen Distefano, Tom Hoover, Sam Distefano, Dayne Mills, Tanner Shay, Levi Hoover, Tyler Johnson, Sherry Smith, Jen Johnson, Dylan Johnson, Jack Distefano, Jacob Kofoet, Timmy Kofoet, Gary Hill, Michael Rudisill, J.D. Taylor, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to approve the minutes with the following correction: page 2 – Girls Scouts did not deliver the luminaries, the Girls Scouts made the luminaries. Unanimously approved.

Christmas Luncheon

The Christmas luncheon will be held on Wednesday, December 24th at 11:00 a.m. at Town Hall.

Misc

A discussion was held regarding the Miss Utility contract. Councilman John Phillips, III stated that he tried to get ahold of Mrs. Dora Parks, but was unsuccessful.

Motion was made by Councilman John Phillips, III, seconded by Councilman Richard Nigh to accept the Miss Utility Agreement revised by the Town Attorney and resubmitted to Miss Utility for agreement. Unanimously approved.

Motion was made by Councilman John Phillips, III, seconded by Councilman Luke Barnette to approve the Miss Utility Resolution. Unanimously approved.

Councilman Rich Gaver gave a report to the Mayor and Council on the Olde Tyme Christmas event.

There were twenty raffle baskets and two ink drawings this year. The Girls Scouts did face painting. There was not a living nativity this year.

The event was a huge success.

Councilman Rich Gaver stated that Vivid Solar will be going door to door in Funkstown explaining their program. Councilman Gaver explained to the Mayor and Council how the program works.

MINUTES

NOVEMBER 10, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, November 10, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Rich Gaver, John Phillips, III, and Richard Nigh.

Also in attendance were Barry Warrenfeltz, Tina Taylor and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman John Phillips, III to approve the minutes. Unanimously approved.

Miss Utility

A lengthy discussion was held regarding the Miss Utility, One Call Center Service Agreement.

The Mayor and Council are very unclear regarding the fees that will be charged to the Town. Councilman John Phillips, III communicates with Mrs. Dora Parks, Manager of Miss Utility, and will call her requesting her attendance to a Mayor and Council meeting.

Motion was made by Councilman Rich Gaver, seconded by Councilman Robert Rodgers, Jr. to hold off adopting the Agreement until additional information is provided. Unanimously approved.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, November 24, 2014 and will be hosted by the Town of Clear Spring. The meeting will be held at the Clear Spring American Legion located at 12335 Big Spring Road.

Misc

Mr. Barry Warrenfeltz asked the Mayor and Council to contact State Highway to have the pothole repaired on the two lane bridge.

The Mayor and Council directed the Town Clerk to see when the County Commissioners are scheduled to hold a meeting in Funkstown.

Councilman Rich Gaver stated that the Girl Scouts will be delivering luminaries this year.

The Boy Scouts will be selling raffle tickets this year for Olde Tyme Christmas.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to purchase two NeatDesk scanners for approximately $800.00. Unanimously approved.

OCTOBER 7, 2014

 

The regular meeting of the Funkstown Mayor and Council was held on Monday, October 7, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., and John Phillips, III.

Also in attendance were J.D. Taylor, Tina Taylor, Kery Swope, Kert Shipway, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Luke Barnette to approve the minutes. Unanimously approved.

Audit Report – Albright Crumbacker Moul & Itell, LLC

Mr. Kert Shipway, Partner with Albright Crumbacker Moul & Itell, LLC presented the annual audit report. The Town has a “clean, unqualified opinion”.

The assets of the Town exceeded its liabilities at the close of the fiscal year by $3,811,595 (net position). Of this amount, $125,133 (unrestricted net position) may be used to meet the Town’s ongoing obligations to citizens and creditors.

The total net position increased by $54,320. Of this amount, an increase of $38,874 and $15,446 were associated with governmental and business-type activities, respectively.

As of the close of the current fiscal year, the Town’s general fund reported a fund balance of $225,016, or 64.8 percent of total general fund expenditures, which is an increase of $46,075 in comparison to the prior year.

The net position for business-type activities (Water and Sewer) increased by $15,466.

Governmental activities net position was $625,013 at the end of the fiscal year, an increase of $38,874 over beginning net position. Program expenditures exceeded program revenues by $251,576 while general revenues were $290,450 during the year.

Business-type activities net position was $3,186,582 at the end of the fiscal year, an increase of $15,446 over beginning net position. Water and sewer program charges for services exceeded expenditures by $13,269 during the year.

Miss Utility

Miss Utility paperwork was tabled until next month.

SEPTEMBER 8, 2014

Minutes

Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to approve the minutes with the following correction: remove Assistant Mayor Sharon Chirgott from the attendance list. Unanimously approved.

MML Dinner

A count was taken for the next MML Dinner to be hosted by the Town of Keedysville on Monday, September 22, 2014. The dinner will be held at the McClellan Gun Club located at 5241 Red Hill Road.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m. The menu for the evening will consist of grilled steak, baked potato, green beans and dessert. The cost for this meal will be $22.00.

Misc

The Funkstown Volunteer Fire Company will be celebrating Fire Prevention Week on Saturday, October 11, 2014 from 9:00 a.m. to 4:00 p.m. with an open house/public safety day. The fire department is requesting permission to close South West Wide Avenue from Baltimore Street to Maple Street.

The fire department is also extending an open invitation for the Mayor and Council to attend the event.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to allow the fire department to close West Side Avenue from Baltimore Street to Maple Street for the open house/public safety day on October 11, 2014 from 9:00 a.m. to 4:00 p.m. Unanimously approved.

Mr. Charles Bailey introduced himself to the Mayor and Council. He is a candidate for the Delegate position for District 2-A. He presented the Mayor and Council a State flag to hang outside of Town Hall.

Councilman Rich Gaver stated that the plans for Old Tyme Christmas have started. The second bridge will be on the ornament this year.

Councilman Rich Gaver stated that Donald Brake has a very nice metal detector, and is willing to help the Town locate memorabilia.

Councilman Rich Gaver stated that the 9th Annual Antietam Rubbish Round-up is scheduled for Saturday, September 20, 2014 from 9:00 a.m. to 1:00 p.m. Those interested should meet behind the American Legion. The Boy Scouts will be participating.

AUGUST 11, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, August 11, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Rich Gaver, John Phillips, III, and Richard Nigh.

Also in attendance were Jeff Metz, Adam Metz, Will Hilderbrand, Barry Warrenfeltz, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Motion was made by Councilman Rich Gaver, seconded by Councilman Luke Barnette to approve the minutes for June 16, 2014. Unanimously approved.

Motion was made by Councilman Rich Gaver, seconded by Councilman Luke Barnette to approve the minutes for July 21, 2014. Unanimously approved.

Misc

Adam Metz is with the Boy Scouts Troop 23. He talked about the Geocaching project that has been started in Funkstown. The first day seven people started with the project. To date, a total of twenty-one people are involved with Geocaching.

Will Hilderbrand is with the Boy Scouts Troop 23. He is working on his Eagle Project, and would like to construct a 10×24 pavilion by the old bathroom where the concrete pad is currently located.

Motion was made by Councilman John Phillips, III, seconded by Councilman Robert Rodgers, Jr. to allow Will Hilderbrand to move forward with the project. Unanimously approved.

Councilman John Phillips, III thanked the Mayor and Council for covering the Re-enactment while he was away.

A lengthy discussion was held regarding dogs running loose in the park. Several council members wanted to enforce no pets allowed in the park, but the motion did not move forward.

Motion was made by Councilman John Phillips, III, seconded by Councilman Robert Rodgers, Jr. to enforce that pets must be on a leash at all times, and two signs will be posted in the park. Unanimously approved.

Councilman Robert Rodgers, Jr., provided a report from the fire company for the Re-enactment. They made $1,700 in profit for the day.

JULY 21, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, July 21, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Councilman Rich Gaver, and Councilman Robert Rodgers, Jr.

Also in attendance were Beth Sullivan, Michelle McKay, Doug McKay, Kyle McKay, Tim Campbell, Mychael Campbell, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Due to a lack of a quorum, the minutes will be adopted at a regular meeting next month.

Beth Sullivan – 21 Frederick Road

Mrs. Sullivan lives at 21 Frederick Road. The house was built eight years ago, and is located on the east side of the entrance on Maple Street next to the post office.

Mrs. Sullivan provided the Mayor and Council with pictures showing how her property floods during heavy rain storms. The water comes from the tennis courts, across the parking lot onto her property.

The flooding doesn’t last a long time, but makes things very muddy.

Mrs. Sullivan stated that she would appreciate anything that the Town can do to help alleviate the problem. Councilman Rich Gaver stated that the County is not set up to handle large amounts of rain.

The Mayor and Council will look at the area, but could not make any promises at this time.

Misc

Kyle Mckay is with the Boy Scouts Troop 23. He is working on his Eagle Project, and would like to get the Mayor and Council’s permission for a project. The project that he would like to work on is a Henry Harp Monument to be built in the park. It would be a bronze plaque 36” high, and 36” wide. There would be a flower bed behind the plaque, and a flag pole. He would like to work on this project in the spring of 2015.

Mayor Paul Crampton, Jr. approved the project, and asked Councilman Rich Gaver to head up the project since he is a Scout Leader with Troop 23.

Mychael Campbell is with the Boy Scouts Troop 23. He is working on his Eagle Project, and would like to get the Mayor and Council’s permission for a project. The project that he would like to work on is repairing the fence at the cemetery on the West Cemetery Street side.

Mayor Paul Crampton, Jr. approved the project, as long as the Cemetery Board agrees to the project. If the Cemetery Board agrees, Mayor Crampton asked Councilman Rich Gaver to head up the project since he is a Scout Leader with Troop 23.

Councilman Rich Gaver handed out a paper regarding the Funkstown Historical Walkabout.

“The new walkabout in Funkstown was placed by Jr BassAssassin (Adam Metz) and Eagle Eye 123 (Rich Gaver) with a special thanks to Terbear (Terry Williams) for her efforts in the placing of this cache. The different stages of the cache take you to 11 historic sites in Funkstown before the final cache point. Each stage requires you to find the cache, inside the cache is a clue that will include a number which then goes into the final cache coordinates. This is a family friendly cache and is very educational about Funkstown. It is about a mile to walk and takes about an hour to complete.”

Councilman Rich Gaver stated that the Day In the Park side of the Re-enactment had an excellent turnout. The entire day went smooth. The Boy Scouts cleaned up the park on Sunday morning.

Councilman Robert Rodgers, Jr. stated that the food sold by the fire company for the Re-enactment went very well. He doesn’t have a final tally yet, but a lot of food was sold.

Councilman Robert Rodgers, Jr. stated that Tuesday, August 5, 2014 is National Night Out. St. Paul’s Lutheran Church will have hamburgers and hot dogs, and everyone is welcome to attend the event.

Mayor Paul Crampton, Jr. stated that he talked to Ronny Shank. The Civil War Trust will like to put a lecture together at Town Hall.

Mayor Paul Crampton, Jr. stated that Comptroller Franchot will be touring the park tomorrow. The Town will be hosting a luncheon for him starting at 12:00 noon in the park.

MINUTES

JUNE 23, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, June 23, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Assistant Mayor Sharon Chirgott, Robert Rodgers, Jr., Luke Barnette, and Richard Nigh.

Also in attendance were Julie Greene, Herald Mail; and Brenda Haynes, Clerk-Treasurer.

Budget

Assistant Mayor Sharon Chirgott stated that the purpose of the meeting is to adopt the General Fund Budget and the Enterprise Fund Budget.

The proposed increase this fiscal year for the General Fund Budget is to increase the Constant Yield Tax Rate from .35 to .36. The proposed increases for the Enterprise Fund Budget are a 2% water rate increase, and increase the sewer charge by $25.00 per quarter for residential units, and commercial and rental units with a different formula.

Motion was made by Councilman Robert Rodgers, Jr., seconded by Councilman Richard Nigh, and carried (2-1) to approve the General Fund Budget. Councilman Luke Barnette voted in the negative.

Motion was made by Councilman Luke Barnette, seconded by Councilman Robert Rodgers, Jr. to approve the Enterprise Fund Budget. Unanimously approved.

Motion was made by Councilman Robert Rodgers, Jr., seconded by Councilman Luke Barnette to approve the Budget Ordinance. Unanimously approved.

JUNE 16, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, June 16, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Robert Rodgers, Jr., Luke Barnette, Richard Nigh, and John Phillips, III.

Also in attendance were Betty Arnall, J.D Taylor, Tina Taylor, Jerald Minkin, and Brenda Haynes, Clerk-Treasurer.

Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to approve the minutes. Unanimously approved.

Misc

Mr. Jerald Minkin rents the property at 36 Frederick Road for the purpose of storing and warehousing merchandise until sold or offered for sale.

Mr. Minkin was issued a Cease and Desist Order because he has items outside on tables under a tent.

Part of the agreement when signing the Zoning Certification, Mr. Minkin agreed to only have items displayed in a tasteful manner on the exterior of the premises for sale between the hours of 8:00 a.m. and 5:00 p.m. daily. No canopies, tents, temporary or permanent structures, tables, benches, or storage sheds shall be allowed on the exterior.

Mr. Minkin stated that he has the area roped off because vehicles drive through his property.

Mayor Paul Crampton, Jr. stated that the entire issue is costing the Town money that has not been budgeted because Mr. Minkin refuses to cooperate.

Motion was made, seconded and carried to contact Mr. Grimm and the Town Attorney to move full speed ahead to bring the problem into compliance. Unanimously approved.

Councilman John Phillips, III stated that the re-enactment plans are coming along fine. The fireworks display and the band have been confirmed.

The regular meeting of the Funkstown Mayor and Council was held on Monday, May 19, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, Richard Nigh, and John Phillips, III.

Swearing In Of Mayor and Council

Public Hearing

The meeting this evening is being called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to a proposed 6.5% water rate increase, Constant Yield Tax Rate change from .35 to .36 per hundred due to residential property assessments decreasing which means no additional out of pocket expense for property owners, and adoption of the General Fund and Enterprise Fund Budget.

The public hearing is scheduled pursuant to the provisions of the Annotated Code of Maryland and the Charter of the Town of Funkstown, to consider whether or not to revise the water rates, and adopt the budgets.

The Mayor and Council will make a determination at a regular meeting to be held June 23, 2014.

Waste Collection Bid

Waste Collection Bid results are as follows:

Allied Waste Services of Hagerstown:   $48,072.84

Apple Valley Waste Services, LLC           $55.592.00

Motion was made by Councilman Robert Rodgers, Jr., seconded by Assistant Mayor Sharon Chirgott to accept Allied Waste Services of Hagerstown in the amount of $48,072.84. Approved five to one… Councilman Luke Barnette voted No… Majority decision approved.

Misc

Councilman John Phillips, III stated that the next Re-enactment plans are under way.   Deposit has been made with the band, and the application has been sent to Mr. Cosgrove with the fireworks.

Councilman Rich Gaver thanked the church for allowing the boy scouts to have the spaghetti dinner at the church.

Budget – Workshop Meeting
A Budget workshop meeting has been scheduled for Monday, April 28, 2014 at 6:00 p.m. to discuss the
budget.
Town Clean Up
Town Clean Up has been scheduled for Friday, May 2nd, from 8:00 a.m. to 3:00 p.m. and on Saturday,
May 3rd from 8:00 a.m. to 12:00 noon. The dumpster will be located at the Funkstown Community
Park, and will leave promptly at 3:00 p.m. on Friday, and at 12:00 noon on Saturday. This service is only

MARCH 10, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, March 10, 2014 at 7:00 p.m. at the Funkstown Volunteer Fire Company.

In attendance were Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, Robert Rodgers, Jr., and Richard Nigh, and John Phillips, III.

Also in attendance were Barry Warrenfeltz, Dale Hill, Dave Fraley, Eric Fraley, David Harman, Jarred Harman, Stephen Lohr, Kevin Kotanko, Morgan Kotanko, Joan Kotanko, Charlie Evans and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Councilman Richard Nigh, seconded by Councilman Rich Gaver to approve the minutes.  Unanimously approved.

Funkstown Fire Company

A lengthy presentation was held by Eric Fraley, deputy chief of the Funkstown Fire Company outlining the company’s funding challenges.  Over the last 20 months, the company has paid $22,000 for fuel, $4,500 to test equipment and $78,000 in maintenance costs.

The plan would be implemented over a period of years, but Phase I would help companies with their immediate needs.  Future phases will be worked into the plan, including possible consideration of a tax to fund fire service in the county.

Phase one of the plan was supported by the Washington County Volunteer Fire and Rescue Association.

County Commissioner Ruth Anne Callaham spoke favorably of the funding plan.

The Mayor and Council voted unanimously to endorse the first phase of a proposed plan to help fire and rescue operations cover their expenses.

Town of Williamsport

A count was taken for the next MML Dinner to be hosted by the Town of Williamsport.  The meeting will be held at the Williamsport Red Men located at 16129 Lappans Road.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of a ten ounce rib-eye steak, a half of pound of steamed shrimp, baked potato, salad and rolls.

The cost for this meal will be $23.00 per person.

Misc

A discussion was held regarding possibly making changes to the Zoning Ordinance.  The sections are Article 4: Lot Area and Yard Regulations, Section 407, Accessory Buildings in Side and Rear Yards, and Article 7: Sign Regulations.

Planning Commission Chairman Doug Stone stated that he will get some background information from other jurisdictions, and schedule a meeting.

Mr. Barry Warrenfeltz stated that the Frederick Street Bridge has a major pothole, and needs to be repaired.  State Highway will be called to repair the pothole.

Councilman Rich Gaver stated that the Boy Scouts went to Annapolis to the Naval Academy for a badge project.

JANUARY 13, 2014

The regular meeting of the Funkstown Mayor and Council was held on Monday, January 13, 2014 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Luke Barnette, Robert Rodgers, Jr., Richard Nigh, and John Phillips, III.

Also in attendance were Barry Warrenfeltz, Doug Hutzell and Brenda Haynes, Clerk-Treasurer.

The meeting was called to order as a Public Hearing by the Mayor and Council for the sole purpose of receiving comments in reference to extending the Utility Recovery Fee (URF) until June 30, 2014.

The public hearing is scheduled pursuant to the provisions of the Annotated Code of Maryland and the Charter of The Town of Funkstown, to consider whether or not to extend the Utility Recovery Fee (URF).

The Mayor and Council will make a determination at a regular meeting following the Public Hearing held this evening.

There were no citizen comments or questions.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman John Phillips, III to close the public hearing.  Unanimously approved.

Doug Hutzell – Watershed Map

A watershed map has been developed to identify drainage areas that flow into the Antietam Creek.

A lengthy discussion was held regarding the watershed map to help with prioritizing stormwater treatment facilities, such as a Bio-swale to treat nutrients run-off.  This will be a start for the Town to acquire credits to satisfy the state’s Water Implementation Plan.

The next step will be to determine what area to start with.

Resolution – CDBG

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Luke Barnette to readopt the Resolution Adopting Maryland Department of Housing and Community Development (DHCD), and Maryland Community Development Block Grant (CDBG) Program, Policies, Procedures and Regulations to be Eligible and Remain Eligible for Participation in the Programs.  Unanimously approved.

MML Dinner

A count was taken for the next MML Dinner will be held on Monday, January 24, 2014 and will be hosted by the City of Hagerstown.  The meeting will be held at the Academy Theater Banquet and Conference Center located at 58 East Washington Street.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.   The menu for the evening will consist of Taris Major Steak with Béarnaise Sauce and Petite Crab Cake, Oven Roasted Rosemary Bliss Potatoes, Seasoned Carrots, Salad, and Dessert.  The cost for this meal will be $22.00 per person.

Utility Recovery Fee (URF)

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman John Phillips, III to approve the extension of the Utility Recovery Fee (URF) until June 30, 2014.  Unanimously approved.

Motion was made by Councilman Luke Barnette, seconded by Councilman Richard Nigh to pay the bills.  Unanimously approved.

Misc

Councilman Robert Roberts, Jr. discussed a Community Shred project.  The cost is $1,000.  Councilman Roberts is trying to get sponsorship for half of the cost, and would like the Town to offset the difference.

Motion was made by Councilman John Phillips, III, seconded by Councilman Luke Barnette for the Town to pay match fifty percent.  Unanimously approved.
