MINUTES

DECEMBER 9, 2013

The regular meeting of the Funkstown Mayor and Council was held on Monday, December 9, 2013 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, Robert Rodgers, Jr., and Richard Nigh, and John Phillips, III.

Also in attendance were Barry Warrenfeltz, Dale Hill, Funkstown Fire Company; Dave Fraley, Funkstown Fire Company, Bobby Watson, Irene Owens, Gregory Sullivan, Julie Greene, Herald-Mail; Doug Stone, Stephanie Stone, Kyle Campbell, Christian Sherwood, James Becker, Michael Campbell, Anthony Pence, Jake Pence, Karin Campbell, Tim Campbell, Melissa Sherwood, and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the minutes.  Unanimously approved.

Funkstown Fire Company

Mr. Dale Hill, President of the Funkstown Fire Company requested to the Mayor and Council that the siren in the bell tower at Town Hall maintain its position.  The fire company would like to repair the siren and use for natural disasters.  If the siren at the fire company stops working, they would like to be able to use the siren until the other siren is repaired.  The fire company would also like to test the siren twice a year.

Mayor Crampton looked at the structure, and stated that the structure is a steel frame, and the siren does not appear to pose a risk to the structure.

Mr. Greg Sullivan is in opposition to the siren being repaired.

Mr. Doug Stone is in opposition to the siren being repaired and put back into the original use, but agrees with the fire company proposal.

A lengthy discussion was held regarding the necessity of the siren.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to allow the Funkstown Fire Company to keep the siren in the bell tower at Town Hall.  The Funkstown Fire Company will repair the siren, and only use the siren for natural disaster emergency notification, test the siren twice a year, and allow the fire company to use the siren for a maximum time of thirty days if the fire company siren is not working.  Unanimously approved.

Olde Tyme Christmas Report

Councilman Rich Gaver stated that the Olde Tyme Christmas plans are coming along great.  There are new decorations courtesy of Mr. Watson.  Miss Nancy from St. Paul’s Lutheran Church is preparing the raffle baskets.  The tables for the craft sale are sold out.  The Funkstown Fire Company will be serving a roast beef dinner.

Mayor Paul Crampton, Jr. stated that the Town had a small sewage overflow of approximately 1,000 gallons from the manhole on Lagoon Road.  The overflow was handled very quickly.  The Town notified Maryland Department of the Environment and the Washington County Health Department of the overflow.

Christmas Luncheon

The Christmas luncheon is scheduled for December 24, 2013 at 11:00 a.m. at Town Hall.

Assistant Mayor Sharon Chirgott stated that she attended the Greater Hagerstown meeting on October 25, 2013 on behalf of Mayor Paul Crampton, Jr.

NOVEMBER 11, 2013

The regular meeting of the Funkstown Mayor and Council was held on Monday, November 11, 2013 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, Robert Rodgers, Jr., and Richard Nigh.

Also in attendance were Barry Warrenfeltz, Timmy Kofoet, Jacob Kofoet, Dayne Mills, Tunner Shay, Levi Hoover, Tyler Johnson, Dylan Johnson, Jen Johnson, Sherry Smith, Joseph Royce, Bill Snodderly, J.D. Taylor, Tina Taylor, Lea Hudson, and  Brenda Haynes, Clerk-Treasurer.

Minutes

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to approve the minutes with the following correction: Under Misc – change bell tower to bell siren.  Unanimously approved.

Doug Hutzell – Stormwater Runoff Issues

Mr. Doug Hutzell is an Environmental Project Manager with Frederick Seibert & Associates, Inc. (FSA)  On Friday, September 13, 2013 FSA met with Councilmen John Phillips, III,  David Biser and Susan Simonson of ACWA to discuss stormwater issues within the corporate limits of Funkstown.  FSA proposes to develop a watershed map to identify drainage areas that flow into the Antietam Creek.  FSA will provide 12 hours of CAD work to generate a map of individual watersheds.  The Town of Funkstown will supply an aerial image showing two foot contours.

The watershed map would be utilized to help with prioritizing stormwater treatment facilities, such as Bio-swale to treat nutrients run-off.  This would be a start for the Town to acquire credits to satisfy the state’s Water Implementation Plan.

The cost for this work is $600.00.

Motion was made by Councilman Luke Barnette, seconded by Councilman Rich Gaver to move forward with the proposal in the amount of $600.00.  Unanimously approved.

Joe Royce – Siren above Town Hall

Mr. Joe Royce is representing the Funkstown Fire Company.  Mr. Royce stated that the fire company would like to repair the fire siren and continue to use it.

The Mayor and Council stated that there are structural problems where the siren is located.

Town resident, Mr. Greg Sullivan stated that the siren hasn’t worked for two months, and the Town has enjoyed the quiet.

A lengthy discussion was heard regarding the need for the siren to be repaired or to be removed.  Mr. Royce stated that he would not comment of whether the siren is needed.  He was asked by the fire chief to attend the meeting to get permission to have the siren repaired.

Motion was made by Councilman Luke Barnette, seconded by Councilman Rich Gaver , and carried (4-1) to discontinue allowing the siren to ring at Town Hall.  (Councilman Robert Rodgers, Jr. voted in the negative.)

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, November 25, 2013 and will be hosted by the Town of Clear Spring.  The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of steamed shrimp, prime rib, scalloped potatoes, green beans, garden salad, rolls and butter, dessert, ice tea and coffee.  The cost for this meal will be $25.00 per person.

Aerators – Conservit

Mayor Paul Crampton, Jr. stated that the aerators that were used for the Lagoon System have been sitting at the treatment plant.  Aerators are no longer used in Maryland, so trying to sell them has been impossible.

The Town will scrap the aerators and take them to Conservit.  The motors will go to Cumberland Valley Recycle.

Misc

Mr. Bill Snodderly thanked the Mayor and Council for paving Edgewood Drive.  He stated that the paving is a great improvement.

Mayor Paul Crampton, Jr. stated that the Board of County Commissioners has been a great help allowing the Town to pave the road under the County paving program.

Mr. Snodderly stated that he appreciates everything the Town has done.

Mayor Paul Crampton, Jr. stated the Columbia Gas will be replacing gas lines over a three year plan.

Boy Scout Troop Two Otterbein United Methodist Church attended the meeting.

Councilman Rich Gaver stated that the Olde Tyme Christmas plans are coming along.  The church has most of the craft tables sold.  The Christmas Ornaments are ready for sale.

Councilman Robert Rodgers, Jr. stated that he would like to incorporate community shred with the Town clean-up day.

Mayor Paul Crampton, Jr. stated that the Town will be working on applying for a CDBG grant for ADA compliance for the upstairs of Town Hall.

Mayor Paul Crampton, Jr. stated that he went to the American Legion Veterans Day Ceremony.  Councilman Richard Nigh laid the wreaths.

AUGUST 12, 2013

The regular meeting of the Funkstown Mayor and Council was held on Monday, August 12, 2013 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, Robert Rodgers, Jr., Richard Nigh and John Phillips, III.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the minutes.  Unanimously approved.

Email from Sheriff Mullendore  – Noise Ordinance

Sheriff Mullendore provided an email to the Mayor and Council regarding the Noise and Loitering Ordinances.  Sheriff Mullendore stated that the U.S. Supreme Court has in all cases struck down Loitering Laws as unconstitutional.  He does not recommend adoption of Loitering Ordinances.

Animal Health Clinic of Funkstown

The Animal Health Clinic of Funkstown will host a Pup Crawl on Saturday, September 21st from 10 am-2 pm.  They will be celebrating 20 years, and will offer many activities.  Enter to win a flat screen tv.  For more information visit www.funkstownvet.com.

Funkstown Fire Company

The Funkstown Fire Company will hold their 13th annual Funkstown Fire Company Duck Race on Saturday, August 31st.

Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to approve a $100 donation.  Unanimously approved.

Misc

Councilman John Phillips, III thanked everyone that helped with the Re-enactment.  The event was a huge success.  The dates for next year will be July 19-20, 2014.

Mayor Paul Crampton stated that Tom Riford with the Washington County Vistors Bureau will donate $100 towards the Re-enactment event.

Councilman Rich Gaver stated that the Day In The Park event was also a huge success considering the rain and humidity.

There is $806.00 towards the Civil War Monument.

Councilman Robert Rodgers thanked the committee event for the hard work with the Re-enactment and the Day In ThePark.

Councilman Luke Barnette stated that the Antietam Creek Watershed Alliance will have a cleanup on Saturday, September 21st from, 8 am – 1 pm.  Food will be served afterwards.

Kevin Walters

Mr. Walters requested permission to use the Little League Field at the Funkstown Community Park for practice.  The baseball team is a travelling team.  While the team is using the field, they will maintain it.

Misc

Mr. Brian Binkley stated that he received a letter from the Washington County Restaurant and Beverage Association, Inc. expressing their concern regarding the proposed noise ordinance and the affect it will have on the bars and restaurants in Funkstown.

Councilman John Phillips, III stated that the re-enactment plans are doing great.  There will be a lot of re-enactors this year.

Councilman Rich Gaver stated that the Day in the Park event is coming along good.  Vendors are still signing up.

Mayor Paul Crampton, Jr. thanked the City of Hagerstown for funding the sidewalk project on Frederick Street.

Budget Ordinance Resolution

Watershed Implementation Plan – Resolution

Motion was made by Councilman John Phillips, III, seconded by Assistant Mayor Sharon Chirgott to approve the Watershed Implementation Plan.  Unanimously approved.

Establishing a Financial Hardship Exemption Plan – Resolution

Motion was made by Councilman Robert Rodgers, Jr., seconded by Councilman Luke Barnette to approve the Financial Hardship Exemption Plan Resolution.  Unanimously approved.

Noise and Loitering Ordinance

The Noise and Loitering Ordinance was introduced to the Mayor and Council.  They will take the information home for review, and possible adoption at the meeting next month.

Misc

Mr. and Mrs. Taylor live at 17 North Antietam Street.  They are very concerned with the motorcycles speeding and running stop signs throughout the Town.

Mr. and Mrs. Arnall have lived in Funkstown for many years, and the increased noise and motorcycles that are coming from Joker’s Bar and Grill is terrible.  The motorcycles are very noisy, speeding through the Town, and running stop signs.  When the bar closes, the manager comes outside and talks with the people that are hanging outside the bar, and they are very noisy.

Mr. Tim Ryan lives at 6 East Baltimore Street.  He is very concerned with the noise from the motorcycles, and the people hanging outside the bar being very loud.

Mr. Thompson lives at 6 East Baltimore Street.  He is very concerned with the noise from the motorcycles, and the people hanging outside the bar being very loud.

Ms. Josette Gustavson is the owner at Joker’s Bar and Grill.  She stated that the manager, Bryan, worked the past weekend, and when the motorcycles left they were very quiet, and did not make noise leaving.

Ms. Gustavson indicated that she has made an effort to quite the noise for the residents of the Town.  Saturday is the only day that colors and cuts are allowed at the bar

Mayor Paul Crampton, Jr. stated that it is up to the owner of the establishment to control the patrons of the bar, and to keep the noise under control.

Councilman John Phillips stated the re-enactment plans are coming along great.  There will be over two hundred (200) re-enactors for the event.

Motion was made by Councilman John Phillips, III, seconded by Councilman Luke Barnette to approve the minutes.  Unanimously approved.

Waste Collection Bid Acceptance

Apple Valley Waste is the only company to bid on the waste collection contract for next fiscal year.  Their bid is $51,122.88 for the fiscal year July 1, 2013 to June 30, 2014.

Motion was made by Councilman John Phillips, III, seconded by Councilman Rich Gaver to approve  Apple Valley Waste bid in the amount of $51,122.88 for the fiscal year July 1, 2013 to June 30, 2014.  Unanimously approved.

A lengthy conversation was held regarding a two year bid for next year.

Motion was made by Councilman Richard Nigh, seconded by Councilman Rich Gaver to request bids next year for a two year bid with the option to renew for another two year bid if the Mayor and Council is pleased with the Waste Collection Company.  Unanimously approved.

MML Dinner

A count was taken for the next MML Dinner to be held at the Municipal Stadium with the Hagerstown Suns on Monday, May 20, 2013.  The gates will open at 5:30 p.m. for the MML picnic and meeting.  Guests will assemble at the Garden from 5:30 – 7:30 where a buffet of all you can eat Ribs, Hamburgers, Hotdogs, Beans, Potato Salad, and Fruit.  The cost is $23.00 per person.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the bills.  Unanimously approved.

Misc

Mr. Tom McDonald is a resident of Funkstown, and lives at the Antietam Trailer Park.  He is disabled, and struggles to make his daily walk to the post office because there is no crosswalk on Frederick Road.

Mayor Paul Crampton stated that Frederick Road is a State Highway, but the Mayor and Council would be willing to put in a request with the State.

Councilman John Phillips, III stated that the Re-enactment plans are moving along good.

Councilman Rich Gaver stated that the Day In The Park plans are also moving along good.

Constant Yield Tax Rate

Section 6-308 of the Tax Property Article, Annotated Code of Maryland, requires the Department of Assessments and Taxation to certify to all taxing authorities a Constant Yield Tax Rate that will produce the same revenue in the coming taxable year that was produced in the prior taxable year.  This does not prevent the reduction of the tax rate.

The current tax rate per $100 is .32.  The net assessable real property base is lower this year, therefore, to maintain the same potential revenue; the tax rate per $100 should be .35.

Washington County Sheriff’s Dept. – 1st Quarter Statistical Information Report

The Mayor and Council reviewed the 1st Quarter Statistical Information Report from January 1, 2013 – March 31, 2013.

The Washington County Sheriff’s Office responded to 186 calls for service during this time frame and 17 resulted in reports being filed.

Twenty-eight citations and twenty warnings were written during the time the Town contracted a deputy to patrol.

Misc

Josh Snope thanked the Mayor and Council for allowing the Boy Scouts to use the upstairs of Town Hall.

Patric Rose informed the Mayor and Council that the Boy Scouts are selling tickets for a  spaghetti dinner. The dinner will be held on Saturday, May 18th from 5:00 to 8:00 p.m. at the Funkstown Fire Company.  Advanced tickets are $5.50 per person, and at the door $8.00 per person.

Mayor Paul Crampton introduced County Commissioner Jeff Cline.  Mr. Cline thanked the Boy Scouts for their excellent work in the community.

FEBRUARY 11, 2013

The regular meeting of the Funkstown Mayor and Council was held on Monday, February 11, 2013 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Rich Gaver, Luke Barnette, and John Phillips, III.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman John Phillips, III to approve the minutes.  Unanimously approved.

Misc

Mr. Barry Warrenfeltz stated that the storm drain on the corner of Chestnut Street and Antietam Street needs repaired.  The grate is rusted.

The town clerk was directed to have the maintenance supervisor repair the storm drain.

Mr. Barry Warrenfeltz stated that the Last Man’s Stand club will possibly donate a flag pole for the monument.

Mr. Barry Warrenfeltz questioned if the Mayor and Council have considered a replacement for the Appeals Board.

Mayor Paul Crampton stated that was up for discussion this evening.

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman John Phillips to appoint Ann Platou as the Chairman of the Appeals Board. Unanimously approved.

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips to move Barry Warrenfeltz from an Alternate on the Appeals Board to a member.  Unanimously approved.

The Mayor and Council will consider an Alternate at a future meeting.

Councilman John Phillips stated that the re-enactment committee will have a meeting on Wednesday, February 13th at 6:00 p.m. at the fire company.

The federal and union side will be represented at the meeting.

Councilman John Phillips stated that if the Mayor and Council is in favor of the same band, he will contact them for a contract providing the price is the same as last year.

Mr. Cosgrove will be in charge of the fireworks again this year.

Councilman Rich Gaver stated that Boy Scouts and Girl Scouts will help this year with the Day In the Park side of the re-enactment activity.

Assistant Mayor Sharon Chirgott asked Mayor Crampton if he has heard any news regarding the Southern Blvd.

Mayor Paul Crampton stated that the Mayor and Council need to be vocal to the County Commissioners to keep the project on the table.

Town resident Ms. Mary Grace asked the Mayor and Council about possible speed cameras on Baltimore Street.

Mayor Paul Crampton stated that he has already checked into the possibility of speed cameras, but it is not allowed because speed cameras are used within a school zone.  Baltimore Street does not fall under that category.

Motion was made by Councilman Rich Gaver, seconded by Assistant Mayor Sharon Chirgott to pay the bills.  Unanimously approved.

MINUTES

JANUARY 14, 2013

The regular meeting of the Funkstown Mayor and Council was held on Monday, January 14, 2013 at 7:00 p.m. in the Mayor and Council Chambers at Town Hall.

In attendance were Mayor Paul Crampton, Jr., Assistant Mayor Sharon Chirgott, Robert Rodgers, Jr., Rich Gaver, Richard Nigh, Luke Barnette, and John Phillips, III.

Also in attendance were Barry Warrenfeltz and Brenda Haynes, Clerk-Treasurer.

A moment of silence was held, followed by the Pledge of Allegiance by full assemblage.

Minutes

Motion was made by Assistant Mayor Sharon Chirgott, seconded by Councilman Rich Gaver to approve the minutes.  Unanimously approved.

MML Dinner

A count was taken for the next MML Dinner to be held on Monday, January 28, 2013, and will be hosted by the Town of Sharpsburg.  The meeting will be held at Shepherd’s Spring Ministry Center located at 16869 Taylor’s Landing Road.

The social hour will begin at 6:00 p.m. followed by the evening meal at 6:45 p.m.  The menu for the evening will consist of spaghetti and meat sauce, garlic bread, steamed broccoli, salad bar and brownies.  The cost for this meal will be $16.00 per person.

Luke Barnette – Funkstown Community Park

Councilman Luke Barnette questioned if the park gate could be locked at night.  Mayor Paul Crampton stated that the Sheriff’s Department will not patrol the park if the gates are locked.

Councilman Luke Barnette stated that the dusk to dawn light on the garage at the park is not working.  Councilman Rich Gaver stated that the light does not work, because there is no electricity at the garage.

Misc

Assistant Mayor Sharon Chirgott stated that she attended the Community Outreach Meeting at the Sheriff’s Department.  A discussion was held regarding speeding on Baltimore Street.  A deputy will enforce the problem.

Bills

Motion was made by Councilman Rich Gaver, seconded by Councilman John Phillips III  to pay the bills.  Unanimously approved.
